Terms and Conditions
1. Introduction
1.1 TJC GLOBAL provides specialist assistance to individuals and companies in respect to multiple language translations and interpreting services. TJC GLOBAL also undertakes on behalf of Customers business project management and industrial co-ordination involving multiple languages.
2. Definitions
2.1 In these terms and conditions the following meanings shall apply: "TJC GLOBAL" means TJC GLOBAL LTD, a business carried out from 38 Walton Street, Oxford, UK and includes any employee, agent or other person that it engages to assist in the provision of the services. "Customer" means a person or company for whom services are provided by TJC GLOBAL. "Services" means the agreed services to be provided by TJC GLOBAL. "Charges" mean the charges invoiced by TJC GLOBAL for the provision of its services.
3. Services to be provided
3.1 TJC GLOBAL will provide the Customer with interpreting and /or translation services and / or co-ordination and project management involving the languages listed under our service. TJC GLOBAL is available to provide assistance on short or urgent notice but any request made by a Customer should be confirmed immediately in writing, by fax, or by e-mail to avoid any unnecessary delay in starting the required work.
4. Charges
4.1. Standard charges of TJC GLOBAL are based on hourly or daily rates for interpreting services and advisory work; the level of these charges depends upon the complexity and urgency of the Customer's requirements. The charges for translations also depend on the source and target languages in some cases and the degree of urgency and complexity of the work. TJC GLOBAL, in principle, determines quotations on the number of words or characters in the original document and the nature of the document.
4.2. Standard charges of TJC GLOBAL are reviewed and, if appropriate, amended annually on 1st January of each year. A copy is available upon request. In the absence of a quotation for the work undertaken, the rates in force at the date of invoice will apply.
4.3. TJC GLOBAL will also be pleased to undertake work at a negotiated fee, subject to our proposals being confirmed or accepted in writing by the Customer.
4.4. TJC GLOBAL will invoice the Customer upon the completion of the work within the month for any one item of work, but where the work is ongoing, we will send out an interim invoice at the end of each month. Our charges must be paid within 28 days from receipt of our invoice and if not paid by the due date, TJC GLOBAL reserves the right to charge a daily penalty fee calculated from the total invoice amount at 2% above the base rate of the National Westminster Bank plc at the date of the invoice, or 1% added to the UK inflation rate of the applicable month and charged monthly. These terms may only be varied if agreed in writing with TJC GLOBAL.
5. Customer Restrictions
5.1. Customers must not knowingly approach (or allow themselves to be approached), directly use, employ or liaise with any of our personnel or consultants without the express prior approval of TJC GLOBAL. If a Customer does engage with such a person without our consent then a fee will become payable by the Customer to TJC GLOBAL, of an amount equal to 50% of all gross fees or monies paid to that person in the 12 month period from the beginning of their engagement.

6.2 TJC GLOBAL will treat all of the information it receives concerning a Customer or the Customers’ business as confidential and will not use or disclose any such information without the Customers’ consent unless otherwise required by law.
7. Cancellation of work
7.1 If, following the customer's written or verbal confirmation of an agreement on using our services, the customer cancels in less than 7 working days before the assignment, we will charge 100% of the full cost of the assignment+ expenses incurred. After 7 days, a charge of 50% of the full cost of the assignment + expenses incurred will apply.
8. Liability
8.1 Although TJC GLOBAL will use its best endeavors to provide a fast and accurate service for all Customers, we restrict our liability for any fault on our part (except in respect of death or personal injury caused by our negligence) to the amount paid by the Customer or otherwise payable in respect of the relevant services or to the sum of £1000.00 depending on whichever is the lower fee.
9. Termination
9.1. We shall be entitled to terminate the Contract or proceedings with you at any time by written notice if:
9.2. You commit a breach of the Contract and, in some cases, fail to remedy the breach that is deemed amendable within 7 days of receipt of a written notice from us.
9.3. You become bankrupt or (being a company) become subject to an administrative order or go into liquidation, or any situation that threatens your financial backing and credibility as a client.
10. Health and Safety
10.1 TJC GLOBAL acknowledges our statutory responsibility to co-operate with the client company's health and safety requirements, provided that TJC GLOBAL is given notice of these. Whilst on company premises our staff shall be afforded by the company the same protection for health and safety purposes as is due to its employees. If we are required by the company to enter the premises of a third party, the company will ensure that the third party also affords such protection to our partners and staff as is due to its employees.
11. Force Majeure
11.1 TJC GLOBAL shall not be liable in any way for failure or delay in performing our obligations under this engagement if the failure or delay is due to causes outside the reasonable control of the party in default, such as, but not restricted to, accident or injury, delay of flight or train, natural disaster or severe weather conditions.
12. Governing Law and Jurisdiction
12.1 These terms of business shall be governed by and construed in accordance with the laws of England and Wales and any dispute arising out of this engagement or these terms shall be subject to the exclusive jurisdiction of the English courts.
13. Email delivery/electronic file delivery
13.1 Emails and files we send electronically are expected to arrive swiftly and intact. If you do not receive an expected email/file within 24 hours, TJC GLOBAL urges you to contact us and request a re-send. If an email sent from TJC GLOBAL is received satisfactorily on one or more than one occasion, any non-delivery will need to be resolved on the recipient’s side. TJC GLOBAL will send email to an alternative email address upon request.
14. Notices
14.1 All notices or other communications under a contract shall be sent in writing to the other party's principal place of business (in the case of the company, it is the business address set out in the invoice Order), or to other addresses given by the party or to the address of the other party to which normal communications relating to the contract have been or are being sent in the ordinary course of business.
15. Site Use Policy
15.1 We provide the public (including those for registered Members) areas of the website for your information and consultation. We agree to your viewing, printing and downloading (archiving) for the previously stated reasons. You agree to adhere to the request that contents are not to be used for commercial gain.
15.2 We assert intellectual ownership of all original works and therefore you may not alter, re-publish, derive or distribute content from this website in any way other than those expressly permitted.
15.3 You may not use whole or individual pieces of the website (including our logos, trademarks, images, meta-tags, design and layout) without the informed and explicit permission of TJC GLOBAL. If you do not agree to these conditions, TJC GLOBAL will end our permission for you to use our site.
16. External Links Policy
16.1 For your convenience we may provide links to external content or websites. We do not endorse or provide approval for the content of external sites or links we may have included. We are not responsible for the services, resources, or products of third parties and cannot guarantee them in any way.
17. Testimonial/personal Comment
17.1 Whilst TJC GLOBAL encourages the sharing of opinion regarding our quality of service and experience, we do not endorse comments from individuals. Any comments or statements which are posted by individuals regarding other persons are the responsibility of the individual concerned. You agree to cover TJC GLOBAL for any cost, fees or liabilities which may arise as a direct result of your comments.
17.2 TJC GLOBAL endeavours to screen all testimonials that are posted on this site but ultimately we reserve the right to withdraw any previously available material should we deem it necessary. If you post comments on our website, you are informed that your opinion may be used (with consent) and this may not reflect the opinion of TJC GLOBAL.
17.3 You attest that any content you provide as attachment via email, floppy disk, CD or other electronic means is virus/trojan free and has come from you alone and is not passed off as your own when you obtained it from elsewhere.
17.4 You agree not to attempt to obtain administrator access through manipulation of or submission to our member-only areas. You agree not to subvert or attempt to subvert any security measures which we may have put in place to protect the integrity of data and content of the website.
17.5 You must not utilize false/anonymous email addresses in communication with us, mislead us to your actual identity, or communicate on a person’s behalf without his/her explicit consent.
18. Site availability
18.1 Our aim is to maintain this site and its facilities 365 days a year. TJC GLOBAL endeavours to make the public and member facilities accessible 24 hours a day. However, factors beyond our control might effect the provision of our website. It is thus reasonable to expect, TJC GLOBAL will not reimburse you for consequent loss or be held liable for circumstances beyond our direct influence or control. We do, however, back up our data regularly and execute a coherent and robust security policy to cover for most eventualities.
